1. Definitions

BotFabric Mine”, “we”, “us”, or “our” refers to Fixio, registered in the Netherlands. “Service” means the BotFabric Mine website, downloadable mining software, tools, and documentation. “User”, “you”, or “your” means any person or entity that accesses or uses the Service.

2. Acceptance of Terms

By accessing or using the Service you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. You represent that any information you provide is accurate and complete.

4. Product Description (Mining Software)

BotFabric Mine provides downloadable miners and profiles (e.g., Basic, Starter, Elite, AutoSwitch Pro, LaptopBot, MacBot, ServerBot, FarmBot, StealthBot, and Android PhoneBots). They are sold as one-time purchases. A small transparent devfee (2–5%) is applied only while a miner is running to fund maintenance and improvements. BotFabric does not custody funds or payouts; mining is directed to your own pool/wallet.

5. Orders & Delivery

Upon successful payment, you receive an instant download of your files (digital content). All digital goods are deemed “delivered” when the download link is provided. Because products are digital and tailored to your configuration, all sales are final and non-refundable, except where required by law. If you are an EU consumer, you acknowledge that by starting the download you expressly consent to immediate delivery and waive your 14-day right of withdrawal for digital content.

6. Pricing & Payment

Prices are listed in euros (EUR) and include VAT where applicable. We may change prices at any time. Payments are processed by third-party providers (e.g., Stripe, PayPal, Klarna, iDEAL). We do not store full payment-card details.

7. License & Use (Seat-Based)

We grant you a non-exclusive, non-transferable license to use the downloaded miners for your personal or internal business purposes. Usage is seat-based: one active miner per PC/device (Android PhoneBots count per phone). For additional machines, purchase additional seats or choose products designed for multiple systems (e.g., FarmBot). You may make reasonable backup copies for your own use.

8. License Restrictions

You may not resell, sublicense, distribute, publicly share, reverse engineer, decompile, modify for redistribution, or remove/obfuscate devfee logic. Any breach terminates your license immediately and may result in legal action.

9. Devfee (Transparency)

A small devfee (typically 2–5%, shown per profile) is taken only while the miner runs. Rates may vary by profile and may change with notice in release notes. The devfee does not give BotFabric access to your pool balances or payouts.

10. Pools, Wallets & Payouts

You mine to your own pool/wallet. Payouts, fees, and thresholds are determined by the pool — not by BotFabric. We do not custody funds, cannot reverse transactions, and are not responsible for third-party services.

11. Risk Disclosure & No Financial Advice

Mining returns vary with hardware, uptime, electricity prices, pool rules, market conditions, and network difficulty. Hardware may degrade under sustained load. Nothing in the Service is investment advice. Past performance does not guarantee future results.

12. Updates & Changes

We may provide updates, optimizations, or new profiles. You are responsible for installing updates and maintaining compatible drivers/OS. We may add, change, or discontinue features at any time.

13. Security & Privacy

The miner operates locally and uses network connections primarily for pool communication and the devfee window. We do not collect your hardware details by default. See our Privacy Policy for specifics on logs and optional telemetry.

14. Support

We provide best-effort support via email/chat. Typical response time is 24–48 hours. Provide clear descriptions and, where appropriate, screenshots of pool settings or errors.

15. Refunds

All sales are final once the download link is delivered, except where mandatory consumer law provides otherwise. This does not affect your statutory rights.

16. Limitation of Liability

To the maximum extent permitted by law, BotFabric is not liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill), arising from or related to your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless BotFabric, its directors, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

18. Suspension / Termination

We may suspend or terminate access at any time, with or without notice, for conduct that violates these Terms or is harmful to the Service or others. Upon termination, all licenses granted to you end immediately.

19. Governing Law & Venue

These Terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, unless mandatory law provides otherwise.

20. Changes to Terms

We may update these Terms from time to time. Material changes will be announced at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
